1. OUR STANDARD TERMS AND CONDITIONS OF NIHANSH GLOBAL WEB SERVICES
Below Mentioned are the standard terms and conditions for Website Design and Development, App Development, Hosting Service, Social Media Marketing, Google Ads Marketing, SEO Services And Also Graphics Design Works and also all services mentioned in the website pages which may not be listed here ; undertaken by “Nihansh Global Web Services” herein referred to as “Nihansh Global Web Services” for its clients.
2. NON-DISCLOSURE
We (and any subcontractors/ re-sellers we engage) agree that we will not at any time disclose any of your confidential information to any third party.
3. OUR FEES AND DEPOSITS
A 50% Deposit / Advance Payment Of the total Project Cost Payable under our proposal is due immediately upon you instructing us to proceed with the website design and development work. The remaining 50% shall become due when the work is completed to your reasonable satisfaction. We reserve the right not to commence any work until the deposit has been paid in full. The 50% deposit of advance paid is NON refundable as we book the domain, Hosting And Start Working on Project .
4. VARIATIONS
We are pleased to offer you the opportunity to make revisions to the design. However, we have the right to limit the number
of design proposals to a reasonable amount and may charge for additional designs if you make a change to the original design specification. Our website development phase is flexible and allows certain variations to the original specification. However any major deviation from the specification will be charged as per the variations.If there is any major changes the customer would require to pay additional fees of 3000 Rs.
5. Hosting Limitations (Usage Policy):
We have Two Kinds Of Hosting Platforms in our company. 1) Shared Web Hosing 2) Seperate Web Hosting.
Client Or Customer Can Choose The Hosting Plan They Need. When A Customer Chooses To Go With The Shared Hosting Basis. We Do Not Provide Any C Panel Or FTTP Details Or Any Details Related To The Hosting To The Customer. This Is Due To Multiple Websites Are Hosted In A Single Platform.
1. In Shared Hosting We Give You The Website Log In Details For You To Make Changes In The Website If You Require To Do By Your Own Or Others
2. In This Shared Hosting If You Plan To Change Your Hosting We The Company Charges Rs 3000 For The Transfer Charges
3. We Back Up The Website On Daily, Weekly & Monthly Basis On Different Plans Selected By Customer. So We Will Email You The Back Up Files & We Do Not Back Up Your Website To Your New Hosting. The Customer Will Be Responsible To The Same.
4. If The Back Up Is Crashed Or Damaged or Corrupted or Files Missing The Company Will Try Its Level Best To Provide Maximum Solutions If Not The Company Cannot Be Held Responsible For Any Failure In Uploading As Downloading The Files & Crash In The Website.
5. The Company Is Responsible For The Websites Until It Is Under Company’s Maintanance
6. If Customer opt No 2 Seperate Web Hosting All C Panel & Administrative Access Will Be Given To The Customer
7. Our Shared Hosting Has 3 Month Renewal SSL Certification. In this Case Customer Gets Free SSL For 1 Year With 4 renewals. The Customer Should Keep An Eye On The Renewal Time And Request The Company Through Writing For Renewal. If You Need Dedicated Service For Renewal Automatically Please Opt Our Dedicated Renewal Service With 1200/- Per Annum
8. We Do Not Guarantee The Speed Or The Loading Time Of The Websites.It May Vary Due To Several Factors
The Hosting Is On Shared Basis & The Hosting Will Be In The Company Name If Any Copyright Issues Or Any Issues Regarding Content, Image, Logo, Vedios Or Any Statement Made In The Website Will Be Sole Responsible Of The Customer & The Concerned Contact No, Name , Address,Location Mentioned In The Website Only Will Be Responsible To Answer & The Company Will Not Interfere In Such Matters Because All The Elements Are Done By The Permission Of The Customer.
6. PROJECT DELAYS AND CLIENT LIABILITY
Any time frames or estimates that we give are contingent upon your full co-operation and complete and final content in photography for the work pages. During development there is a certain amount of feedback required in order to progress to subsequent phases. It is required that a single point of contact be appointed from your side and be made available on a daily basis in order to expedite the feedback process.
7. APPROVAL OF WORK
On completion of the work you will be notified and have the opportunity to review it. You must notify us in writing of any unsatisfactory points within 24 Hours of such notification. Any of the work which has not been reported in writing to us as unsatisfactory within the 24 Working Hours review period will be deemed to have been approved. Once approved, or deemed approved, work cannot subsequently be rejected and the contract will be deemed to have been completed and the 50% balance of the project Price will become Due.
8. PAYMENT
Upon completion of the 24 Hours review period, we will invoice you for the 50% balance of the Project.
9. User ID , Passwords & Access
Once you have paid us in full for our work we grant to you User ID , Passwords & Access to use the website and its related software and contents for the life of the website provided regular renewal of subscription is done on or before expiry of the term.
10. DISCLAIMER
To the full extent permitted by law, all terms, conditions, warranties, undertakings, inducements or representations whether express, implied, statutory or otherwise (other than the express provisions of these terms and conditions) relating in any way to the services we provide to you are excluded. Without limiting the above, to the extent permitted by law, any liability of Nihansh Global Web Services under any term, condition, warranty or representation that by law cannot be excluded is, where permitted by law, limited at our option to the replacement, re-repair or re-supply of the services or the payment of the cost of the services that we were contracted to perform.
11. CROSS BROWSER COMPATIBILITY
By using current versions of well supported content management systems such as “Wordpress”, we endeavor to ensure that the web sites we create are compatible with all current modern web browsers such as the most recent versions of Internet
Explorer, Firefox, Google Chrome and Safari. Third party extensions, where used, may not have the same level of support for all browsers. Where appropriate we will substitute alternative extensions or implement other solutions, on a best effort
basis, where any incompatibilities are found.
12. SUPPORT (AFTER SALES ) GUIDELINESS
Nihansh Global Web Services Will Provide You After sales Support Such as Technical Support, Maintenance Support And All Means Of Suppport to Customers Via Support Ticket, Live Chat At Website , And Phone Call Support. Support Over Phone Call And Live Chat Are Available From 10:30 Am to 9:30Pm (IST) Monday To Saturday . However Our 24 Hours E.mail Request Will BE Open.
13. SUPPLY OF MATERIALS (CONTENT)
You must supply all materials and information (Copyrighted Content) required by us to complete the work in accordance with any agreed specification. Such materials may include, but are not limited to, photographs, written copy, logos and other
printed material. If any delay in supplying these materials to us which leads to a delay in the completion of work, we have the right to extend any previously agreed deadlines by a reasonable amount. Also If any content provided by you breaks the
copyrighted rules as mentioned in the The Copyright (Amendment) Act, 2012; then we would remove the content from website without any prior notice.
13. WARRANTY BY YOU AS TO OWNERSHIP OF INTELLECTUAL PROPERTY R
You must obtain all necessary permissions and authorities in respect of the use of all copy, graphic images, registered company logos, names and trade marks, or any other material that you supply to us to include in your website or web
applications. You must indemnify us and hold us harmless from any claims or legal actions related to the content of your website.
14. SEARCH ENGINES
We do not guarantee any specific position in search engine results for your website. We perform basic search engine optimization according to current best practice.
15. BACKUPS
You are responsible for maintaining your own backups with respect to your website and we will not be liable for restoring any client data or client websites except to the extent that such data loss arises out of a negligent act or omission by us.
16. OWNERSHIP OF DOMAIN NAMES AND WEB HOSTING (FILES)
We would book the domain name on your behalf and at any point in time you feel to move out for any reason we would do it in reasonable time and our transfer process is automated, fast and risk-free, so there’s nothing to worry about. And that means that moving your domain/ hosting (files) to any other service provider happens mostly in the background, leaving you with more time to work on your next big thing. Also the transfer happen, when you have no outstanding dues.
The DNS Name Changing Charges To Other Hosting Is 3000 Rs.
17. GOVERNING LAW
The agreement constituted by these terms and conditions and any proposal will be construed according to and is governed by the laws of Bengaluru, Karnataka jurisdiction only. You and Nihansh Global Web Services submit to the non-exclusive jurisdiction of the courts in and of Bengaluru in relation to any dispute arising under these terms and conditions or in relation to any services we perform for you.
18. Policy updates
Nihansh Global Web Services is permitted to revise these Terms of conditions/ services at any time as it sees fit, the orders taken prior to update of terms of conditions will also come under new terms of conditions (If you think the changes made will affect your projects, you need to update us within 10 days of terms of conditions being updated). And by using this Website you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this Website.
19. Service Renewal Policy
During The Renewal Of The Services Like Websites, Domain names, Hosting Or Any Other Services Provided By Us. We Would Inform You In Any Means Of Communucation. Customers Are Liable To Contact The Company In Regards With The Renewal Of Your Service. Post To Which If The Service Is Expired Or If The Service Is Not Available After The Due Date The Company Does Not Hold Any Responsiblity. All The Renewal Dates Will Be Printed On The Receipts For The Customers We Have Given At The Time Of Commencement Of Project.
20. Search Engine Optimization Policy
Seo Have Various Packages and customer can choose any package of their wish. The Company Do Not Promise any position in the search results. seo takes time and patience. So the customer cannot ask for the guaranteed results. No such Promises will be made by the company and any complaints In This regard will not be entertained
21. Google Ad Words
google adwords is a paid platform and all the payments are done through the customers bank account to google account. The Company does not stay liable for any loos of their money. Company charges only the service charges on monthly basis. customer cannot complain on the no of clicks, impressions, targeted locations or any settings done in the adwords. Access will be given to the customer and customer can have timely check on the account where as the company takes the responsiblity to run the ads not the results.
Google Adwords Plan Are Quoted As 5000. And This Amount Of 5000 Is Considered Only For Single Campaign Not For All Listed Campaign.
